Welcome to EDM Awards Canada (the “Platform” or “Services”). These Terms & Conditions (“Terms”) govern your access to and use of the Platform, including membership applications, track submissions, voting, judging, and all related features. By creating an account, submitting an application, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Membership
- You must be at least 19 years of age and legally reside in Canada or be a Canadian citizen/permanent resident to apply for membership.
- Membership is limited to verified industry professionals (artists, agents/managers, labels, publishers) actively working in electronic dance music (EDM).
- Verification is at our sole discretion. We may request additional proof (e.g., DSP links, performance videos, press) and reject or revoke membership without explanation.
- One account per individual or entity. Multiple accounts or false information will result in immediate termination.
2. Track Submissions
- Verified members may submit tracks for consideration in eligible genres during open submission periods.
- Submission fee: Currently $0. Fees are non-refundable except in cases of admin rejection due to ineligibility.
- Eligibility criteria:
- Track must be an original EDM work released within the prior 18 months (e.g., for 2027 Awards: Feb 2025–Jan 2027).
- Primary artist(s) or label must be Canadian (citizen, permanent resident, or Canada-based entity controlling 50%+ of the track).
- MP3 upload (320kbps minimum), plus metadata (title, artists, ISRC, streaming links).
- We review all submissions for genre fit, quality, and eligibility. Approved tracks enter Round 1 voting; rejected tracks receive a credit or refund at our discretion.
3. Voting and Judging Process
Round 1: Member Voting
- Verified members vote in genres matching their profile tags.
- You cannot vote on your own tracks or those from your label/affiliates (auto-filtered).
- Rank up to Top 10 tracks per genre (10 points for #1, 1 point for #10). Partial lists allowed.
- Votes must reflect genuine engagement; minimum listens required per genre.
Round 2: Expert Judging
- Top 10 tracks advance to anonymous expert panels (10+ judges per genre).
- Judges rank Top 5 (5 points for #1, 1 point for #5). Highest total score wins.
- Judge identities and individual rankings remain confidential.
- Results (Top 10, nominees, winners) are published transparently with aggregate scores only.
- We reserve the right to adjust scoring, disqualify votes, or withhold awards for manipulation or disputes.
4. Intellectual Property and Usage Rights
- By submitting a track, you grant EDM Awards Canada a non-exclusive, royalty-free, worldwide licence to:
- Host, stream, and display the track (MP3 + metadata) on the Platform for voting/judging.
- Use excerpts (up to 2 minutes) in promotional materials (e.g., ceremony highlights, social media).
- Full tracks for winners/nominees in official recap content.
- Licence ends 90 days post-Awards unless you opt into extended promo use.
- You retain all ownership rights. Credit must be given as submitted (e.g., “Artist – Track [EDM Awards Canada]”).
- Public charts/results are shareable with attribution.
5. Payments and Fees
- All fees in CAD, processed securely via [e.g., Stripe/PayPal].
- No refunds on submissions or memberships except as stated.
- We are not liable for payment disputes; contact your provider directly.
6. Conduct and Prohibited Activities
- Do not: Create fake accounts, vote collusively, submit ineligible tracks, harass others, or spam.
- Violations lead to account suspension, vote invalidation, or bans without refund.
- We monitor for abuse using analytics and reports.
7. Privacy and Data
- Your data is collected and stored in compliance with Canadian privacy laws (PIPEDA).
- See our separate Privacy Policy for details on collection, use, and disclosure.
- By using the Services, you consent to data processing for Awards purposes (e.g., verification, voting).
8. Limitation of Liability
- Services provided “as is.” We disclaim all warranties (express or implied).
- Maximum liability: amount you paid us in the last 12 months.
- Not liable for indirect damages (e.g., lost opportunities, data loss).
- Awards process is subjective; no guarantees of nomination or win.
9. Events and Ceremony
- Attendance at live events (if any) subject to separate ticket terms.
- We may change dates, formats, or cancel without liability (refunds pro-rated).
10. Termination
- We may suspend/terminate accounts anytime for violations.
- You may delete your account anytime; submitted data may be retained for records.
11. Governing Law
- These Terms governed by Ontario law. Disputes resolved in Toronto courts.
- No class actions.
12. Changes to Terms
- We may update Terms with notice (email or site post). Continued use = acceptance.
